LIMITATION OF LIABILITY

In no event, PC Expert shall be liable to you, or any third party, for any direct, special, indirect, incidental, punitive, exemplary, reliance, or consequential damages of any kind, including, but not limited to, compensation, reimbursement or damages in connection with, arising out of, or relating to, the use, or loss of use of, the site and content, loss of profits, loss of goodwill, loss of data or content, cost of procurement of substitute goods or services, subsequent or other commercial loss, or for any other reason of any kind, whether based on breach of any express or implied warranty or condition, breach of contract or tort (including, without limitation, negligence or strict liability), even if PC Expert has been advised of the possibility of such damages.

SEVERABILITY / ENTIRE AGREEMENT

These T&C, together with the Privacy Policy and any amendments or/and any additional agreements you may enter into with PC Expert in connection with the Services, shall constitute the entire agreement between you and PC Expert concerning the Services. If any provision of these T&C is deemed invalid, illegal or unenforceable, then that such provision shall be enforced to the maximum extent permissible so as to maintain the intent of these T&C, and all other remaining provisions of these Terms will remain in full force and effect.

ASSIGNMENT

These T&C, and any rights and licenses granted hereunder, shall not be transferred or assigned by you to anyone. Whereas, PC Expert can assign such rights and licenses without restriction.

GOVERNING LAW

These T&C will be construed and enforced in all respects in accordance with the laws of India. Your use of this website and any dispute arising out of such use of the website is subject to the laws of India.

JURISDICTION

Any Court of India shall have sole and exclusive jurisdiction for all purposes in connection with any action or proceeding that arises from or relates to, these T&C, and you hereby irrevocably waive any objection to such exclusive jurisdiction; provided, however, that PC Expert may seek to enforce any judgment in its favour in any court of competent jurisdiction. Notwithstanding the foregoing, PC Expert may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its proprietary and other rights. You agree that your breach or threatened breach of these T&C may result in immediate and irreparable damage to PC Expert for which there is no adequate remedy at law. These Terms are only valid in the English language.

CREDITS TRANSFER

We do not entertain any request for Credit Migration / Transfer to another account, route ie. from Transactional to Promotional or vice versa under any circumstances. End users must choose credit distribution among routes / account at the time of top-ups / recharges

VIRTUAL CREDITS – RESELLER ACCOUNTS

Number of Virtual Credits in a Re-Seller Account will be the same as the recharge. Virtual Credits will be transferred to the Re-Seller Account at the time of purchase of actual credits.

If there is need of extra Virtual Credits, they will be made available to the re-seller at an add-on pack. Charges are add-on pack will be Rs. 3000/- (Three Thousand) plus tax per 1 (One) Lac Virtual SMS Credits. 

REFUNDS AND CANCELLATION

We expect our clients to subscribe to our services after demo and proper testing. In case of API’s, we provide our clients sufficient timeframe and test the product before subscribing for the same. Also, our Support team will make sure the issue is resolved once the client registers his/her support complain by emailing on [email protected], thus raising a support ticket. 

We do not entertain any request for Refunds or Cancellation of the Subscribed Services, however, if there is an issue at our end, Clients feedback will be captured and Issue will be resolved.

MISCELLANEOUS

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

All trademarks reproduced in this website, which are not the property of, or licensed to the operator, are acknowledged on the website. Unauthorized use of this website may give rise to a claim for damages and/or be a criminal offence. UPDATION OF T&C

These T&C may be revised from time to time and the updated version will always be posted on the Website. If you do not agree to the new T&C, you will stop accessing the website.
